HOW MANY DAYS DO I HAVE TO PAY?The number of days to pay, or when your ticket must be address by, is noted on the bottom of your ticket (right after the Court name and address) under the heading “Within”. This means that within the time noted you must either return your ticket with a payment OR deny the violation and return it to the court.DO NOT PAY YOUR TICKET WITHIN 14 DAYS AFTER RECEIVING IT.The ticket needs to be processed through the court system and eligibility for the deferral program must be determined. Please wait until you have had your ticket for two weeks before paying it.AFTER PAYING WILL I GET A RECEIPT? CAN I CONTEST MY TICKET?You have the right to contest any ticket you do not agree with and there will be no additional fees.If you are required to pay, your fine will be the same after court as it was beforeTO CONTEST YOUR TICKET:1) Please check the box on your ticket where it states, “I Deny the Violation(s)” and sign and date where indicated.2) IMPORTANT: Make sure that your home address on the ticket is correct.
If not, please write it in neatly somewhere on the ticket. This is where your “Order to Appear” notice will be sent.

An “Order to Appear” notice will be sent by mail with your Court date and time.5) DO NOT APPEAR FOR COURT UNLESS YOU HAVE RECEIVED THE “ORDER TO APPEAR” NOTICE. If you simply show up for court and you are not on the docket, your case will not be heard.WHEN IS COURT HELD?Court hearings and trials are normally held on the last Tuesday of the month beginning at 6:15PM, however, the date may be changed due to holidays, other events, or scheduling conflicts. Please note that the officer who issued your citation is also required to attend your hearing/trial.WHAT IS THE DEFERRAL PROGRAM AND HOW DO I QUALIFY?The deferral program is a PRE-TRIAL diversion that gives you the opportunity to have your ticket (and points) dismissed if you do not have another moving violation within a specified period.
(Six months for local/ordinance violations; one year for state infractions.) If you are eligible for deferral and choose to deny your violation and go to trial, the deferral will no longer be offered.1) Eligibility is based upon your driving record and the type of violation(s) you received.2) We do not determine who is eligible. The County Prosecutor’s office does. They will notify us if you qualify. Please note that drivers under the age of 18 and those with a Commercial License are NOT eligible for deferral.3) If you qualify, you will be notified by mail, by either the Boone Superior Court or the Whitestown Court, with a cover letter explaining the deferral agreement and the deferral form.4) Complete the deferral form and mail it, along with a money order or cashier’s check in the specified amount, to the address in the instructions.5) You can also sign the agreement in-person at the Town Court (if you have been notified that you qualify).
